2. Subject of the Contract
2.1. The Seller agrees to supply the Goods ordered by the Customer, and the Customer agrees to accept and pay for the Goods in accordance with these Terms.
2.2. The description, quantity, price, delivery method, delivery charges and other Order-specific conditions are displayed or communicated to the Customer before the Order is submitted.
2.3. By placing an Order, the Customer confirms that the Customer has had the opportunity to review these Terms and other applicable documents published on the Website, including:
- User Agreement;
- Privacy Policy and Personal Data Processing Notice;
- Cookie Policy;
- Delivery and Payment information;
- Returns and Refund information;
- Marketing Communications Consent, where separately and voluntarily accepted.
2.4. Consent to marketing communications or non-essential cookies is not a condition of purchasing Goods.
2.5. Information about Goods, including descriptions, photographs, sizes, colours and prices, is published on the Website. Reasonable differences in colour may occur depending on the Customer’s screen or device settings.
2.6. Promotions, discounts and special offers may be subject to separate conditions published on the Website.
3. Placing an Order
3.1. The Customer selects the Goods and provides the information necessary to process and deliver the Order.
3.2. Before submitting an Order, the Customer is responsible for checking the selected Goods, size, quantity, delivery details and other Order information.
3.3. If additional information about a product is required, the Customer may contact RUNLAB using the contact details published on the Website before placing the Order.
3.4. An Order may be placed through the Website or by another ordering method expressly offered by RUNLAB.
3.5. After an Order has been submitted, RUNLAB may send an electronic acknowledgement confirming receipt of the Order.
3.6. RUNLAB may contact the Customer where necessary to verify or clarify Order information.
3.7. If an ordered product is unavailable, RUNLAB will inform the Customer as soon as reasonably possible. RUNLAB may offer an alternative product, but the Customer is not required to accept a substitute. Any amount paid for unavailable Goods will be refunded where applicable.
4. Conclusion of the Contract
4.1. Submission of an Order constitutes an offer by the Customer to purchase the selected Goods.
4.2. Unless otherwise stated during checkout, the Contract is concluded when RUNLAB accepts the Order and sends confirmation of acceptance or dispatch.
4.3. RUNLAB may refuse or cancel an Order before acceptance where there is a lawful and reasonable reason to do so, including unavailability of Goods, an obvious pricing or technical error, suspected fraud or inability to process payment.
4.4. If payment has already been received for an Order that is subsequently cancelled by RUNLAB, the relevant payment will be refunded.
5. Rights and Obligations of the Parties
5.1. RUNLAB shall:
- supply Goods in accordance with the Contract;
- supply Goods that conform to the Contract and applicable legal requirements;
- provide information required by applicable consumer protection law;
- arrange delivery in accordance with the selected delivery option;
- respect all mandatory statutory rights of Consumers.
5.2. The Customer shall:
- provide accurate information necessary for processing and delivery of the Order;
- check the Order before submitting it;
- pay the applicable price and delivery charges;
- take reasonable steps necessary to enable successful delivery of the Goods.
6. Prices and Payment
6.1. The price payable for Goods is the price displayed on the Website when the Order is placed, subject to the correction of obvious errors as permitted by law.
6.2. Prices include VAT where applicable unless clearly stated otherwise.
6.3. Any delivery or other mandatory charges will be displayed or otherwise communicated to the Customer before the Order is submitted.
6.4. Payment may be made using the payment methods available on the Website at the time of purchase.
6.5. RUNLAB may restrict certain payment or delivery methods depending on the Order, destination or availability of the relevant service.
7. Delivery
7.1. Goods may be delivered by RUNLAB or by third-party courier or delivery service providers.
7.2. Available delivery methods, destinations, estimated delivery periods and applicable charges are displayed on the Website or during checkout.
7.3. RUNLAB will deliver the Goods within the period agreed with the Customer. Where no delivery period has been specifically agreed, Goods will normally be delivered without undue delay and no later than 30 days after conclusion of the Contract, unless otherwise agreed with the Customer.
7.4. Where the Customer is a Consumer and delivery is arranged by RUNLAB, the risk of loss of or damage to the Goods passes to the Consumer when the Consumer or a third party designated by the Consumer, other than the carrier, physically receives the Goods.
7.5. If the Consumer independently appoints a carrier that was not offered by RUNLAB, risk may pass to the Consumer when the Goods are handed over to that carrier in accordance with applicable law.
7.6. The Customer must provide accurate delivery information and reasonable access necessary for delivery.
7.7. If delivery cannot be completed because the Customer provided incorrect information or failed to collect the Goods, reasonable additional delivery or return costs may apply where permitted by law.
8. Consumer Right of Withdrawal
8.1. A Consumer purchasing Goods through the Website has the right to withdraw from the Contract without giving any reason within 14 days.
8.2. For Goods, the 14-day withdrawal period generally begins on the day on which the Consumer, or a third party designated by the Consumer other than the carrier, acquires physical possession of the Goods.
8.3. To exercise the right of withdrawal, the Consumer must notify RUNLAB of the decision to withdraw by an unequivocal statement before the withdrawal period expires.
8.4. The Consumer may use a model withdrawal form made available by RUNLAB, but use of such a form is not mandatory.
8.5. After notifying RUNLAB of withdrawal, the Consumer must return or send the Goods without undue delay and no later than 14 days after notifying RUNLAB of the withdrawal.
8.6. Unless RUNLAB agrees to bear the cost or applicable law provides otherwise, the Consumer bears the direct cost of returning Goods following a change-of-mind withdrawal, provided that RUNLAB informed the Consumer of this obligation before the Contract was concluded.
8.7. RUNLAB will reimburse payments received from the Consumer, including the cost of the least expensive standard delivery method offered by RUNLAB, without undue delay and no later than 14 days after RUNLAB is informed of the Consumer’s decision to withdraw.
8.8. RUNLAB may withhold reimbursement until the Goods have been received back or until the Consumer provides evidence that the Goods have been sent back, whichever occurs first.
8.9. The refund will normally be made using the same payment method used by the Consumer for the original transaction unless the Consumer expressly agrees otherwise.
8.10. The Consumer is liable only for any diminished value of the Goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
8.11. The right of withdrawal does not apply to Goods or contracts excluded under applicable consumer legislation, including, where relevant, Goods made to the Consumer’s specifications or clearly personalised Goods and other statutory exceptions.
9. Legal Guarantee and Non-Conforming Goods
9.1. Goods supplied by RUNLAB to Consumers must conform to the Contract and to the requirements of applicable Cyprus and European Union consumer law.
9.2. Consumers are entitled to a statutory legal guarantee of conformity of at least two years from delivery of new Goods.
9.3. If the Goods are defective, do not correspond to their description or otherwise lack conformity with the Contract, the Consumer must inform RUNLAB and may exercise the remedies available under applicable law.
9.4. In the event of lack of conformity, the Consumer may request repair or replacement in accordance with applicable law.
9.5. Repair or replacement must be carried out free of charge, within a reasonable period not exceeding 25 days from the date RUNLAB is informed of the lack of conformity, unless the Consumer expressly agrees to an extension, and without significant inconvenience to the Consumer.
9.6. Where repair or replacement is impossible, disproportionate, has not been completed in accordance with applicable law, or where another statutory condition is satisfied, the Consumer may be entitled to an appropriate reduction in price or termination of the Contract and reimbursement.
9.7. The legal guarantee does not cover damage resulting from misuse, accidental damage after delivery, abnormal use, failure to follow reasonable care or usage instructions, or other circumstances for which RUNLAB is not legally responsible.
9.8. These statutory rights are separate from the 14-day right of withdrawal and are not restricted by any voluntary return policy or commercial warranty offered by RUNLAB or a manufacturer.
10. Returns
10.1. Goods returned following withdrawal should be returned with all items and accessories supplied with them.
10.2. Consumers are encouraged to retain proof of purchase and proof of return. The absence of a particular receipt does not automatically remove statutory rights where the purchase can be established by other reasonable evidence.
10.3. Where Goods are returned because of a lack of conformity and the Consumer is entitled to a statutory remedy, the Consumer will not be charged costs that applicable law requires the Seller to bear.
10.4. RUNLAB may offer additional voluntary return or exchange rights beyond statutory rights. Any such additional conditions will be published separately on the Website and will not restrict mandatory Consumer rights.
11. Liability
11.1. RUNLAB and the Customer are responsible for failure to perform their respective contractual obligations in accordance with applicable law.
11.2. RUNLAB shall not be responsible for a failure or delay directly caused by materially incorrect or incomplete information supplied by the Customer where this prevents RUNLAB from properly performing the Contract.
11.3. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
11.4. Nothing in these Terms excludes, limits or otherwise adversely affects the mandatory statutory rights of Consumers.
12. Events Beyond Reasonable Control
12.1. Neither party shall be responsible for delay or failure to perform contractual obligations to the extent caused by circumstances genuinely beyond that party’s reasonable control.
12.2. Such circumstances may include natural disasters, war, civil unrest, serious transport disruption, government restrictions, major infrastructure failures or widespread telecommunications outages.
12.3. The affected party shall take reasonable measures to minimise the effects of such circumstances and resume performance as soon as reasonably possible.
12.4. Nothing in this section removes any mandatory Consumer right to a refund, termination or another statutory remedy.
13. Electronic Communications and Authentication
13.1. Communications relating to Orders and Contracts may be made electronically, including by email, telephone, SMS, authentication code or through the Customer’s Account.
13.2. Where authentication using a telephone number, one-time verification code, email address or another authentication method is used, the Customer is responsible for maintaining reasonable control over the relevant telephone number, device, email account and authentication credentials.
13.3. The Customer should notify RUNLAB without undue delay if the Customer becomes aware of unauthorised access to an Account or authentication credentials.
13.4. Electronic records may be retained and used as evidence of transactions and communications to the extent permitted by applicable law.
14. Personal Data
14.1. Personal data are processed in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR), applicable Cyprus data protection legislation and RUNLAB’s Privacy Policy and Personal Data Processing Notice.
14.2. Personal data necessary for processing, fulfilling and delivering an Order may be processed on the basis of performance of the Contract and other applicable lawful bases without separate consent where consent is not legally required.
14.3. Marketing communications and non-essential cookies are subject to separate consent where such consent is required by applicable law.
15. Changes to these Terms
15.1. RUNLAB may update these Terms from time to time to reflect changes in legislation, Website functionality, business operations or other legitimate requirements.
15.2. The version applicable to an Order is the version in force when the relevant Contract is concluded, unless a subsequent change is required by mandatory law.
15.3. Changes to these Terms will not retrospectively remove rights already acquired by a Customer under an existing Contract.
16. Governing Law and Dispute Resolution
16.1. These Terms and Contracts concluded under them are governed by the laws of the Republic of Cyprus and applicable European Union law.
16.2. Where the Customer is a Consumer, nothing in these Terms deprives the Consumer of any mandatory protections available under applicable law.
16.3. Customers are encouraged to contact RUNLAB first so that complaints or disputes may be resolved amicably where reasonably possible.
16.4. If a dispute cannot be resolved amicably, the parties may use the courts, authorities and other dispute-resolution mechanisms available under applicable law.
17. Applicable Consumer Legislation
These Terms are intended to operate in accordance with applicable legislation of the Republic of Cyprus and European Union law, including the Consumer Protection Law of 2021 (Law 112(I)/2021), as amended, and the Certain Aspects Concerning Contracts for the Sale of Goods Law of 2021 (Law 154(I)/2021), as amended.
18. Legal Guarantee
